The decision by the South African Parliament in February 2018 to review the constitutional property clause possibly allowing for expropriation without compensation has fervently brought the land question back into public debate.

Please register here for online participation Against the backdrop of widespread perceptions that transformative constitutionalism in general and land reform in particular have fallen short of their promises to bring about redistributive justice in substantive and meaningful ways, South African public discourse has been dominated over the past few years by debates about the need to amend the property clause (section 25) of the Constitution to allow for expropriation of land without compensation.

The multi-faceted and thorny issue of land restitution in South Africa - Public lecture by Olaf Zenker
Conceiving land restitution as an exemplary site, at which the moral modernity of the new South African state is contested, renegotiated and made, the lecture thus comes to a qualified conclusion: restitution has been more successful than its public reputation suggests, but can and must be improved to live up to public expectations, said Olaf Zenker, Professor of Social Anthropology at the University of Fribourg.
